DISCLAIMERS
- A. All vehicles sold through URTI’s auction are sold “AS IS, WHERE IS”, WITH NO WARRANTY, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. URTI expressly disclaims the accuracy or completeness of any and all information provided verbally, in writing, or in image form. This information includes, but is not limited to year, make, model, VIN, mileage, odometer disclosures, condition, damage and sale documents.
- B. URTI does not guarantee that vehicles sold can be legally resold or transferred in any state or country. Buyer accepts all risks associated with vehicle title and registration laws for all states and countries.
REGISTRATION
- A. All buyers must be 18 years of age or older and meet all requirements imposed by the federal, state and local government laws and regulations. URTI reserves the right, at its discretion, to deny or revoke participation for any individual or entity.
- B. All current and prospective buyers must possess and provide copies to URTI of all necessary and applicable licenses. We require either an Illinois UDL (salvage, rebuilders, dismantler or recycler) or equivalent from another state. Licenses that are annually renewable must be resubmitted every year to URTI to ensure eligibility.
- C. Buyers are responsible for all transactions and account activity, including, without limitation all bids placed by buyer and authorized bidders for buyer, either in writing, electronically, on a bid sheet, fax or email, or verbally to an URTI authorized auction representative.
- D. Buyers and their guests irrevocably and unconditionally waive and release their rights (if any) to recover from URTI, its directors, officers, employees, representatives, agents, subsidiaries and affiliates any and all damages, losses, liabilities, cost or expenses and claims thereof, whether direct or indirect, known or unknown, foreseen or unforeseen, which may arrive from, or be related to, bodily injury, property damage, or other occurrence which occurs on URTI premises. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, WILL URTI BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOST PROFITS THAT RESULT FROM OR ARE RELATED TO THE SALE, DISTRIBUTION, USE OF, OR INABILITY TO USE, ANY VEHICLE, EVEN IF URTI HAS BEEN ADVISED OF THE DAMAGES.
BID PROCESS
- A. URTI auction managers have a responsibility to ensure that returns are maximized, they may, at their sole discretion, negotiate with the high bidders on any vehicle, not awarded in the first stage, to facilitate an acceptable sale price.
- B. URTI reserves the right to withdraw from auction any vehicle for any reason at any time at its sole and absolute discretion.
- C. Should a tie bid occur, each party will be solicited for a follow-up bid or bids to determine the highest bid.
- D. All bids, once submitted to URTI, in either the first or second stage may not be retracted, deleted or cancelled.
FEES AND PAYMENT
- A. A $25.00 buyer fee will be charged for each vehicle sold. Gate, storage, loading, relists, late and delivery fees will be charged to buyer, if applicable, per vehicle. It is the sole responsibility of the buyer to verify fees charged by URTI prior to bidding and incurring such fees. All fees are subject to change without notice.
- B. Payment for any vehicle awarded is due within 10 calendar days. Vehicles not paid for within this timeframe will be subject to a late fee per vehicle. Vehicles on automatic delivery may be COD, with URTI approval prior to bidding. Payment can be made by cashier’s check, money order, company check, or cash, though cash payments over $5000 will not be accepted. Acceptance of company checks must be approved by URTI prior to bidding. URTI requires a letter of guarantee from buyer’s bank prior to being company check approved. The purchase price and all buyer fees should be paid to United Road Towing, Inc. Tow fees needs to be paid separately to E&R Towing. Please include a copy of the invoice you’re your payment indicating what you are paying for. Auctions should be paid in full not in partial payments.

DELIVERY AND PICKUP
- A. All vehicles purchased at URTI will be initially setup for automatic delivery, which is exempt from storage, gate and loading charges (except in instances where the buyer delays the delivery). URTI will arrange delivery of all vehicles in a timely and efficient manner. Buyer is expected to accept delivery of vehicles during their normal hours of operation.
- B. When a delivery in progress cannot be completed, for whatever reason, buyer will be charged a dry run both ways. Buyer must accept delivery of vehicles when they are scheduled to avoid dry run charges.
- C. In certain circumstances and prearranged, buyers may pickup their own vehicles. Vehicles and fees must be paid before any vehicle is removed from the yard. Gate, loading and storage fees will apply to each vehicle if applicable.
- D. URTI is NOT responsible for damage, missing items or a change in condition of the vehicle after it has been awarded. All vehicles awarded include their contents.
- E. Multi-car carriers are subject to a per vehicle loading fee. URTI is NOT responsible or liable for damage which may be incurred during loading of vehicles.
GENERAL RULES
- All vehicles are sold with either junking certificates (PARTS ONLY) or salvage certificates. THERE ARE NO CLEAN TITLES, and no vehicles are able to be registered “as is”. Upon receipt of payment, junk vehicles will be delivered with a manifest while the application for a junk certificate is in process. The junking certificate will be mailed to you when we receive it from the Secretary of State.
- Buyers are strictly prohibited from contacting, by any means, any former owners, lienholders, and / or any other person or business whatsoever in connection to any vehicle purchased from an URTI auction. Violations may result in immediate and permanent suspension from URTI auctions.
- It is the buyer’s responsibility to make sure the pound manager is aware if a salvage certificate is desired for a particular vehicle. Make sure to check the “title” box every time you bid if you want a salvage certificate. We will apply for a junk certificate if a salvage certificate is not requested BEFORE 3PM ON THE DAY OF THE AUCTION. Again, it is YOUR responsibility to make your wishes clear. We will not change junk to salvage or salvage to junk after the auction is finalized.
- We will keep possession of salvage vehicles until the salvage certificate is received, a process that normally takes three to six weeks. Once a salvage vehicle is cleared by the City, it is towed out of the pound to Markham until the salvage certificate is received. Therefore, there are two towing fees (payable to E&R Towing) for every salvage vehicle – one from the pound to Markham, and one from Markham to the buyer. In addition to the $25 buyer fee per vehicle, there is a $225 administrative fee for salvage certificates, $100 of which is non-refundable.
I have read and understood and agree to be bound by the policies, terms, conditions and information set forth in this agreement as well as the auction rules. I acknowledge that as the registered buyer I am responsible for all bids by authorized bidders.
